Business Terms and Conditions

Aalborg Stevedore Company A/S follows the official terms and conditions applicable to Danish Shipping and Port Companies.

All services rendered are subject to the General Terms of Business 2024 of Danish Shipbrokers and Port Operators, which are available here.

The aforementioned conditions limit our liability for the loss, deterioration or damage of goods to 2 SDR per kg or 666.67 SDR per package or unit. Our liability for simple negligent errors and regulatory requirements is disclaimed and the liability limitation rules of the provisions are maintained in the event of gross negligence. Any compensation cannot exceed 25,000 SDR per damage event. Claims against us are no longer legally enforceable after 10 months. We have pledged both current and previous claims, and the default interest rate is 2% per commenced month. Offsetting payments in our accounts receivable is not permitted. We act solely as an intermediary in the performance of brokerage and agent duties and shall be held indemnified for loss or damage. Any dispute shall be settled in accordance with Danish law and at the Maritime and Commercial Court in Copenhagen as the venue.

Tasks that exceed the scope of DSHAB 2024 or DSAF – as DSAF (section 10) is not deemed adopted between the parties – are executed in accordance with the General Provisions of the Nordic Association of Freight Forwarders (NSAB 2015). The provisions limit our liability for loss, deterioration or damage to the goods to SDR 8.33 per kg, and for delays, up to the freight amount of maximum SDR 50,000 per order. Upon storage, the freight forwarder’s total liability for damage for one and the same event is limited to SDR 500,000 (Section 27). Particular attention is drawn to the fact that claims against the freight forwarder lapse after 1 year (Section 30) and that the right of collateral (Section 14) includes both current and previous claims. Requirements for freight, etc. must be honoured regardless of the terms of delivery of the trade agreement (Section 10).

All orders are subject to the general conditions of NSAB 2015 and DSHAB 2024.
